Ibnu Rusyd is a popular philosopher and very expert in Islamic law study. In his Islamic book under the title of Bidayah alMujtahid he wrote the arguments of some scholars, and then he analyzes the arguments critically and argues the reason of different arguments appearance. Start from this point, he begins to express his arguments related with the problem discussed. This article will explain about his arguments related the state of guardian in a marriage.

One of alternative ways in Islamic financing is by using pawnshop, it is did not need for any difficult requirement even with the process. That is why an institution of Islamic pawnshop has social functions (besides it indicates of business function) towards society benefits as ta’awun (helpful) concept in Islam. But we still need for a review study related with the all transactions and practicalities in the Islamic pawnshop. Practically and operationally, an Islamic pawnshop is more taking part in economic aspect and profits oriented. Only a few of them would be orient in social aspect. The most basic ideology of a pawnshop (rahn) is for tabarru’ (goodness) and not for tijarah (trade).

Greeting of peace and merry Christmas would be contradicted when it involved with the faith. As a consequence, there would be an instruction to ban it. In contrast, it would be not in the same way when it related with the relationship context among human being as a fellow religion in a society. Greeting of merry Christmas could be not understood as a statement accepting and agreeing the Christian believe. The greeting regarded to be allowed as long as it regards as an expression of peace and appreciation in the society as a fellow religion. This is the same way when we come to the celebration for their great day. If a person believes that his faith would be not change, then he is allowed to come to the celebration. On the other hand, if the person afraid of changing his faith, then it would be forbidden to come to their celebration.

A missionary endeavor is a God’s command. There are two kinds of law related with the missionary endeavor called as fardlu ‘ain and fardlu kifayah. The meaning of fardlu ‘ain is an obligation for every Moslem, while fardlu kifayah is an obligation to all every Moslem; the others Moslem should not do the obligation when one Moslem have done it. It considered as fardlu ‘ain if we observe a Moslem as a single personality. Every Moslem has an obligation to have a missionary endeavor in his or her life. Then, it considered as fardlu kifayah when a Moslem of a society has done the obligation instructed. Indirectly, all Moslem in the society should not do the same thing in the same way the Moslem. To carry out the obligation of a missionary endeavor, there are some important things that must to be pay attention such as wisdom ways, there are full of tenderness, sympatric, a wisdom words indicates good advices and etc.

The strong desire of officials’ government to dominate a political power is not only caused by the strong restriction of government toward their political aspiration. But also this is involved by such factors like some desires to increase their income and their career performance, reaching up their prestige, even gaining a popularity. Unfortunately, we could not deny if they were snatching away to compete in the election of a district head. The government must be taking a part to create a clear rule related with this case. The government should criticize to whom breaking the rules decided without any specification. So that, the pros and cons about their participation could be minimize in the election of a district head and the society could accept the problem for this case.

The presence of dying exhortation in Islamic law takes part in an important rule to avoid the turbulences inside of a family. As we know, that sometimes a family member could not receive the wealth left by inheritance way. However, he or she has taken apart for supplying the inheritance wealth. By the existence of inheritance wealth (the obligated dying exhortation) arranged in Islam, the disappointments could be overcome.

A discussion of an interest often brings some contradicted arguments among scholars of Islam. This problem caused by the different comprehension methodology used to comprehend some Koran verses and related hadis itself. We could see the difference when the related verses with interest comprehended separately. As a consequence, there is a contradiction between one verse and others. Thus, we need a solution to solve the problem. For instance, a verse informs about the characteristics of interest; multiplied, on the other side, a scholar allows an interest if the interest is free from the multiplied characteristic. If a scholar stated that multiplied interest is forbidden, then he is not allowed to give many arguments about the problem. This aims to convince the truth of his arguments. In contrast, if the problem considered thematically by using a principle approach of tadarruj (deciding a law continuously), so that the problem related with an interest could be solve. Finally, this study concludes if the verses related with an interest would be not contradicting each other.
